NHRC of India issues an advisory to central & state governments along with union territory administrations to ensure welfare of transgender persons

National Human Rights Commission (NHRC) of India, headed by Justice Arun Mishra issued an advisory to the central and state governments along with union territory administrations to ensure the welfare of transgender persons. The advisory mentions that the rights of transgender persons have gained recognition and legal validity through the enactment of the Transgender Persons (Protection of Rights) Act, 2019. To safeguard transgender persons from discrimination, the commission has issued a list of recommendations. The advisory has focused on six key areas for action to ensure transgender persons get access to education, healthcare, employment, inclusivity, welfare, and grievance redressal.

Some of the key recommendations include the treatment of a single transgender child of a deceased government employee or pensioner as an unmarried daughter for the purpose of family pension and other benefits, allowance of transgender persons to inherit ancestral agricultural land, inclusion of third gender in civil services jobs. It further includes free sex reassignment surgery in government hospitals and provision for separate washrooms for transgender persons in all public places. It has also advised the Ministry of Corporate Affairs to consider incorporating welfare activities of transgender persons.

Secretaries in the Department of Social Justice and Empowerment and Ministry of Corporate Affairs, Chief Secretaries of States and administrators of Union Territories have been asked to implement the recommendations in letter and spirit. The commission has sought for the Action Taken Report within two months.
