Chief Justice of India, Justice Surya Kant today emphasised the importance of the culture of healthy disagreement and deliberation. As part of the ongoing BRICS Chief Justices’ Forum in New Delhi, the Chief Justice of India today addressed the delegations from BRICS Member States and Partner Countries.
He emphasised that timely and predictable delivery of justice is necessary. He reminded how Nalanda University used to be the most eminent educational centre where students and researchers from all over the world used to be admitted without any discrimination or barriers. He added that BRICS should also be known as the living Nalanda University. Today’s gathering was also addressed by the President of the Supreme Federal Court of Brazil, Luiz Edson Fachin, and the Chief Justice of China, Zhang Jun, among others.
Speaking during a Session on mediation, Justice Surya Kant stressed that as trade among countries grows, businesses will need dispute-resolution mechanisms that are efficient, credible and workable across different legal and commercial cultures. He called for the strengthening of cooperation between mediation institutions, professional training, multilingual capacity and dialogue among judges, mediators, lawyers and businesses.
CJI Kant said that India, for its part, has made significant efforts in recent years to place mediation at the centre of its justice system. He highlighted that the nationwide initiative, “Mediation for the Nation”, brought mediation into greater public and institutional focus. He added that the results have been encouraging. He said mediation must be strengthened so that dialogue can prevail, commerce can continue, and trust can grow across BRICS Members and Partner Countries.
The four substantive sessions in which discussions were held today include Mediation and International Commercial Disputes, Cross-Border Enforcement of Arbitral Awards, Artificial Intelligence and the Judiciary and Judicial Leadership and Sustainable Development. The Forum enabled closer judicial dialogue, promotion of exchange of experiences and deeper cooperation among BRICS Member States and Partner Countries on emerging legal and institutional issues.
