Calcutta High Court has reserved its order on the appeal of the West Bengal government on the death sentence of the RG Kar Medical College case convict Sanjay Rai. The case was heard by the division bench of Justices Debanshu Basak and Md Sabbar Rashidi. The state government appealed to the court demanding a death sentence.
Central Bureau of Investigation CBI has challenged the appeal of the state government on the ground that it is investigating the case and the state government has no locus standi to appeal.
Earlier CBI had demanded a death sentence for Sanjay Rai in the sessions court but the court said that it is not the rarest of rare case to give capital punishment.
