The Delhi High Court reserved its order on the maintainability of the plea by Delhi Chief Minister Arvind Kejriwal’s aide Bibhav Kumar challenging his arrest in the Swati Maliwal assault case on Friday. Justice Swarana Kanta Sharma reserved the judgment on maintainability after the Delhi Police opposed the issuance of notice on the plea.
Mr. Kumar, in his plea, has sought a direction to declare his arrest as illegal and in gross violation of the provisions of Section 41A (notice of appearance before a police officer) of the Code of Criminal Procedure and against the mandate of the law. Bibhav Kumar was arrested on May 18 in connection with the FIR registered on the written complaint of Aam Aadmi Party’s Rajya Sabha MP Swati Maliwal. She alleged that Kumar assaulted her when she went to meet Mr. Kejriwal at his residence on May 13.
